If you serve and you don’t have a will, your family could pay the price

The reality most serving personnel don’t think about

Surveys consistently show that a majority of UK adults do not have a valid will — including many serving military personnel. If you die without one, your estate passes under intestacy rules, which may not reflect your wishes and can cause serious financial and legal complications for the people you leave behind. For military personnel — who face elevated operational risk, may have complex beneficiary arrangements, and whose pension death-benefit nomination sits separately from their estate— this is not a hypothetical risk. It is a real and immediate one.

A will is not just for older people. For anyone with dependants, a partner, children, property or a preference about how their estate should be managed, a will is the most fundamental piece of financial planning they can put in place. The good news: through Absolute Military’s partnership with Make a Will Online, you can have a solicitor-checked will in place today — completely free as an Absolute Military member. Absolute Military pays the £60 fee on your behalf.

Operational risk is real
Military personnel in operational roles face risks that most civilians do not. Without a will, an unexpected death on operations or during training leaves your estate subject to intestacy rules — which may not reflect your wishes regarding your partner, children, or specific assets.
Intestacy may not protect your partner
If you are not married to your partner, they receive nothing under intestacy rules. Only legally recognised spouses and civil partners inherit automatically without a will. For unmarried military couples — which is common — this is a critical gap that a will closes immediately.
Children’s guardianship must be specified
Only a will allows you to formally name a guardian for your minor children. Without one, the courts decide. For military families where both parents may be serving, or where one parent has sole care, this is particularly important to address formally.
Overseas postings add complexity
If you own or have acquired property or assets overseas during a posting, English intestacy rules may interact with local inheritance law in ways that cause complications for your beneficiaries. A properly prepared will can address this.

Inheritance tax planning
A will is the primary tool for mitigating the impact of inheritance tax on your estate. Trusts, specific bequests and careful beneficiary structuring can all reduce the tax burden on your family — but only if addressed within a valid will.

Circumstances change frequently
Military life involves frequent changes: marriages, children, promotions, property purchases, overseas postings. A will made at 22 may be completely inadequate at 32. Make a Will Online includes lifetime updates, so your will stays current as your life changes.

Important: your pension death-benefit nomination and your will are separate

If you die while serving, the Armed Forces Pension Scheme (AFPS) pays a tax-free death-in-service lump sum — typically four times your pensionable pay under the current AFPS 15 scheme. It is paid to the person you name on your pension nomination form (AFPS Form 2) and sits entirely outside your estate. It does not pass under your will.

That leaves you with two separate documents that must be kept consistent: your AFPS Form 2 nomination and your will. They easily fall out of step, and the consequences are real. A nomination naming a parent, sibling or former partner stays in force until you actively change it. And note the asymmetry: getting married automatically revokes your existing will, but it does not update your pension nomination. If your circumstances have changed since you last completed Form 2, your lump sum and the rest of your estate could end up going to different people. Review both together, and again after any major life event.

(The Armed Forces Compensation Scheme — AFCS — is a separate scheme again: it covers death or injury caused by service, with survivor benefits paid under its own eligibility rules, not by free nomination.)

Solicitor-checked online wills — the only provider with SRA approval

Make a Will Online is not a standard will-writing service. It is the only online provider in the UK to have been granted an Innovation Space Waiver by the Solicitors Regulation Authority (SRA) — meaning their employed solicitors are specifically authorised to check and approve wills for members of the public online. Anyone else offering an “online will service” or a “legal check” is typically using a will writer, not a solicitor. The difference is significant.

SRA Innovation Space Waiver
The only online will provider granted consent by the Solicitors Regulation Authority to provide solicitor services to the public. Every will is checked by a qualified solicitor before issue.

Three steps to a solicitor-checked will

  1. Answer straightforward online questions

The online process takes you through a clear set of questions about your beneficiaries, assets, guardianship wishes and executors. You will need the names and addresses of anyone you intend to name. You can save and return at any time via an email link — useful if you are doing this from camp or during a duty period.

  2. Review — and only pay when you are happy

Review your completed will before anything is charged. As an Absolute Military member, Absolute Military pays the fee on your behalf — you pay nothing. A solicitor checks the will before it is finalised and issued to you.

  3. Receive your solicitor-checked will by email or post

Your completed, solicitor-checked will arrives by email as standard. Optional printing, binding and postage is available for £15 per document if you want a physical copy. Your lifetime updates are included from the moment of purchase.

Frequently Asked Questions

Why is a will especially important if I am serving?

Military personnel face a combination of factors that make a will particularly urgent: elevated operational risk compared to civilians, the likelihood of having dependants who are not married partners, complexity around overseas assets from postings, and the need to ensure their pension death-benefit nomination is consistent with their estate wishes. Without a will, your estate passes under intestacy rules — which may not protect an unmarried partner, may not reflect your wishes regarding your children, and may create avoidable inheritance tax liability. A free solicitor-checked will — covered by Absolute Military for all members — closes all of these gaps.

What is the difference between Make a Will Online and a standard will writer?

Anyone can call themselves a will writer in the UK — there is no regulated qualification required. Make a Will Online is the only online provider to have received an Innovation Space Waiver from the Solicitors Regulation Authority (SRA), meaning their employed solicitors are authorised to check and approve wills for members of the public online. Every will created through the service is reviewed by a qualified, SRA-regulated solicitor before it is issued. This gives you the legal assurance of traditional solicitor will-writing at a fraction of the cost — and for Absolute Military members, the fee is paid by Absolute Military, making it completely free.

My pension death-benefit nomination is already in place — do I still need a will?

Yes. Your nomination form (AFPS Form 2) covers only your Armed Forces Pension Scheme death-in-service lump sum, which is paid directly to your named beneficiary and sits outside your estate. Everything else you own — property, savings, investments, personal possessions, and any life insurance not written in trust — is distributed under your will, or under intestacy rules if you don’t have one. The two are entirely separate documents covering entirely separate assets. You need both in place, consistent with each other, and reviewed together whenever your circumstances change — particularly after marriage, which revokes your existing will but leaves your pension nomination untouched.

Can I update my will if I get married, have children or buy a house?

Yes — and with Make a Will Online, updates are free for life. As a member, Absolute Military covers the cost (normally £60 single, £90 pair) and you can update your will as many times as you need as your circumstances change. This is especially valuable for military personnel, whose lives change frequently through postings, relationships, children and property. Traditional solicitors charge for each amendment — Make a Will Online’s lifetime updates mean you will never pay again to keep your will current. Note: getting married automatically revokes a previous will under English law, so reviewing your will after major life events is essential.

I am currently posted overseas — can I still make a will?

Yes. Make a Will Online is available 24 hours a day, 7 days a week, from anywhere in the world. The process is entirely online and you can save and return via email link at any time. However, their wills are fully legal in England and Wales only. If you own property overseas or are resident abroad, local inheritance law may interact with your English will in complex ways — you should seek specialist advice for any overseas assets. For the purpose of an English and Welsh will covering your UK estate, the service is fully accessible from any overseas posting.

Do I need to be an Absolute Military member to access this?

Yes — the free will service is exclusively for Absolute Military members. Absolute Military pays the fee on your behalf through the exclusive member link. Membership is free, open to all serving personnel, veterans, reservists, MOD civilians and their families, and takes under two minutes to register. In addition to the will service, membership also unlocks the Travel Concierge, Monthly Prize Draw, £200 Mortgage Cash Back and Discount Codes.
